StarrBase Terms of Service

StarrBase Music is operated by Adam Kuhn, based in Tamworth, New South Wales, Australia (referred to in these Terms as "StarrBase Music", "we", "us", or "our"). StarrBase Music provides a direct-to-fan music platform that includes public artist profiles, release pages, event pages, electronic press kit pages, digital music sales, fan streaming access, artist subscription communities, and an affiliate program.

These Terms apply to all visitors, registered users, artists, fans, and any person accessing public or authenticated surfaces of StarrBase Music.

You must be at least 16 years old to create an account and use StarrBase Music. By registering, you confirm that you meet this requirement. If you are using StarrBase Music on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete registration and profile information and keep it up to date.
• You may not impersonate another person, artist, or entity.
• You may not transfer your account to another person without written permission from StarrBase Music.
• Anonymous draft sessions exist for the EPK builder and do not constitute registered accounts.

StarrBase Music currently provides the following services: a digital music marketplace for artist-to-fan sales, fan streaming libraries built from purchases and active support subscriptions, public artist profiles and release pages, electronic press kit pages, artist event pages, a Streaming+ subscription for expanded listening access, artist subscription communities through Members pages, artist support subscriptions and tips, and an affiliate referral program for EPK sales.

Features may be added, changed, limited, or removed over time. StarrBase Music does not guarantee that any specific feature will remain available indefinitely.

You retain ownership of content you upload or publish to StarrBase Music, including music files, artwork, profile media, biography text, event details, EPK content, and Members community content (collectively, "User Content").

By uploading or publishing User Content, you grant StarrBase Music a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, stream, display, distribute, and otherwise make User Content available as required to operate, improve, secure, and promote StarrBase Music services.

• You represent that you own or control all rights necessary to upload and publish your User Content.
• You are responsible for all rights clearances, licences, and permissions relating to recordings, compositions, artwork, likenesses, and other protected material you upload.
• You are responsible for the accuracy of all metadata, including artist identity, credits, and release details.

You may not use StarrBase Music to violate applicable law, infringe third-party rights, abuse platform systems, or harm users or StarrBase Music. Prohibited conduct includes:

• Uploading or publishing content without the required rights or permissions.
• Fraud, payment abuse, chargeback abuse, or any attempt to circumvent payment systems.
• Impersonation, deceptive identity practices, or operating fake profiles.
• Distributing malware, probing security systems, gaining unauthorised access, or scraping the platform at abusive scale.
• Harassment, threats, hate speech, or publishing unlawful content.
• Artificially manipulating engagement metrics, analytics, rankings, or gamification systems.
• Commercially redistributing or reselling content obtained through StarrBase Music without express written permission.
• Self-referral abuse in the affiliate program, including using your own referral code to generate commissions on your own purchases.

StarrBase Music enables artists to sell digital music products directly to fans. Unless expressly stated otherwise, a purchase grants the buyer a personal, non-exclusive, non-transferable licence for private listening use only. Purchases do not transfer copyright ownership in any musical work or recording.

• Delivery is provided through account-based library access and time-limited secure download links.
• Download links may expire after a set period. If your download link expires, contact support@starrbase.xyz.
• Artist content availability may change due to artist edits, removals, rights disputes, policy enforcement, or technical issues.
• StarrBase Music may block, delay, or reverse access where required for fraud prevention, legal compliance, or rights enforcement.

Digital goods purchases are non-refundable except where required under Australian Consumer Law or other applicable mandatory law. If you believe a purchase was made in error or is subject to a consumer guarantee, contact support@starrbase.xyz.

StarrBase Music supports recurring artist support subscriptions and one-time artist tips, both processed through Stripe. Subscription billing is recurring until cancelled. Cancellation timing is governed by Stripe billing settings and the subscription terms shown at checkout.

• Active support subscriptions may provide access to artist Members community content and streaming library content depending on individual artist configuration.
• One-time tips are single non-recurring payments and do not create ongoing entitlements.
• Artist support availability can be enabled or disabled by the artist at any time.
• Subscription prices, benefits, and access terms may change with notice as required by applicable law.

Artist support subscriptions and tips are non-refundable except where required under Australian Consumer Law or other applicable mandatory law.

Streaming on StarrBase Music is provided for personal, non-commercial use only. You may not copy, redistribute, retransmit, publicly perform, or otherwise exploit streamed content except as permitted by law or explicit product terms.

Your streaming library reflects your current purchases and active support subscription status. Library content may change as artist catalogues are updated or support subscriptions are cancelled. StarrBase Music does not guarantee uninterrupted or perpetual access to any specific recording.

Streaming+ is an optional recurring subscription that provides expanded streaming access. Streaming+ billing and cancellation terms are presented at checkout and are processed through Stripe.

Artists may build and publish an Electronic Press Kit through StarrBase Music. Creating and editing an EPK is free. Publishing an EPK to a permanent public URL requires a one-time payment of $14.99 USD. This is a lifetime unlock with no ongoing subscription requirement.

• Published EPK pages are publicly accessible and may be indexed by search engines.
• You are responsible for the accuracy and legality of all content in your EPK, including biography text, press photos, music links, and booking contact details.
• StarrBase Music may remove or restrict EPK pages that violate these Terms or applicable law.
• EPK unlock payments are non-refundable except where required under Australian Consumer Law.

Artists who have purchased and published their EPK and have an active Stripe Connect account are eligible to participate in the StarrBase Music affiliate program. Eligible artists may generate a unique referral link and earn a commission of $3.00 USD for each qualifying EPK purchase made by a new customer through their referral link.

• Commissions are paid to the affiliate's connected Stripe account after the qualifying purchase is confirmed and any applicable refund period has passed.
• Self-referral is prohibited. Using your own referral code to earn a commission on your own EPK purchase will result in the commission being cancelled.
• StarrBase Music reserves the right to cancel commissions associated with fraudulent purchases, chargebacks, or violations of these Terms.
• StarrBase Music may modify, suspend, or terminate the affiliate program at any time with reasonable notice.

Artists who monetise on StarrBase Music are responsible for ensuring their listed content and commercial activity comply with applicable law, including rights clearance, accurate pricing, and correct release metadata.

• Payouts are contingent on completing Stripe Connect onboarding and maintaining a valid, active Stripe Connect account.
• The platform fee is 10% of the gross sale amount plus applicable Stripe payment processing costs. Artists receive the remaining amount.
• StarrBase Music may withhold, delay, reverse, or offset amounts in cases of fraud risk, chargebacks, policy violations, or legal obligations.
• Artists are solely responsible for their own tax reporting and compliance obligations arising from sales and other income through StarrBase Music.

Many surfaces of StarrBase Music are public by design, including artist profiles, release pages, event pages, and EPK pages. You are responsible for what you choose to publish publicly.

StarrBase Music may moderate, remove, restrict, de-rank, or disable content or account access where necessary for safety, rights protection, legal compliance, or platform integrity.

StarrBase Music software, design systems, trademarks, logos, and platform content (excluding User Content) are owned by StarrBase Music or its licensors and are protected under Australian and applicable international intellectual property laws.

We grant you a limited, revocable, non-transferable licence to use StarrBase Music in accordance with these Terms. Nothing in these Terms grants you any ownership interest in StarrBase Music or its intellectual property.

If you believe content on StarrBase Music infringes your intellectual property rights, contact us at questions@starrbase.xyz with sufficient detail to identify the work claimed to be infringed, the location of the allegedly infringing material on StarrBase Music, your authority to make the claim, and your contact details. We will review and respond to valid notices in accordance with applicable law.

StarrBase Music relies on third-party providers for core functionality. These include Firebase and Google Cloud for authentication, database, storage, and server functions; Stripe and Stripe Connect for payment processing, subscriptions, and artist payouts; the Spotify API for music search and metadata; and Google Analytics, Google Ads, Meta Pixel, and Reddit Pixel for analytics and advertising measurement. Your use of these integrated services may also be subject to those providers' own terms and privacy policies.

You may stop using StarrBase Music at any time. You may request account deletion through your dashboard. StarrBase Music may suspend or terminate access, remove content, or restrict features where we have reasonable grounds to believe there is fraud, abuse, rights infringement, legal risk, safety risk, or a violation of these Terms.

Account deletion does not automatically remove all records. We may retain records required for security, fraud prevention, accounting, legal obligations, and dispute resolution.

StarrBase Music is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, StarrBase Music disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

StarrBase Music does not guarantee commercial outcomes, audience growth, revenue results, discoverability, or continued access to any specific content or feature. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

To the fullest extent permitted by the laws of New South Wales and the Commonwealth of Australia, StarrBase Music will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business interruption arising from or related to your use of StarrBase Music.

Where liability cannot be excluded under the Australian Consumer Law or other mandatory law, StarrBase Music's liability is limited to the maximum extent permitted by that law, including where applicable, at StarrBase Music's election, to the re-supply of the relevant service or the cost of having the service re-supplied.

You agree to indemnify and hold harmless StarrBase Music and its officers, agents, and contractors from and against any claims, liabilities, damages, losses, and costs (including reasonable legal costs) arising from your User Content, your use of StarrBase Music, your breach of these Terms, or your infringement of any third-party rights.

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with these Terms.

Before initiating formal proceedings, we encourage you to contact us at support@starrbase.xyz so we can attempt to resolve any dispute informally.

We may update these Terms from time to time. When we make material changes, we will update the effective date and provide notice where required by law. Continued use of StarrBase Music after updated Terms become effective constitutes your acceptance of the updated Terms.
